DL Aid quater in force
Over €9 billion of subsidies, NRRP-NICEP commission strengthened
The Official Journal of November 18 published the Decree Law on "Urgent support measures in the
energy sector and public finance," the so-called Aid quater, which was numbered 176 of 2022 and
entered into force on Saturday, November 19. The measure is now pending in Parliament for the
conversion process, which is expected to begin in the Senate.
Consisting of 16 articles, and four annexes, the measure provides supports (and more) totaling slightly more than 9 billion euros.
In brief, the DL includes the extension of the tax credit for companies and businesses for the purchase of electricity and natural gas (Art. 1); the extension until the end of the year of the tax cut on gasoline, diesel, menthane and LPG (Art. 2); the boost to domestic upstream linked to the gas delivery mechanism (art. 4); the revision of the Superbonus with the deduction dropping from 110 percent to 90 percent (art. 9); and the postponement by one year - to January 2024 - of the end of consumer protection on gas, aligning the deadline with the one now in place for domestic in electricity (art. 5).
Still, DL Aids quater included, among other things, the strengthening of the NRRP-NICEP Commission with 30 additional commissioners (Art. 11); changes to the rule - introduced by DL Energy No. 17/2022 - on the use of military state property for the installation of RES plants (Art. 6); the limitation to "companies with a registered office or permanent establishment in Italy" for access to the subsidies due to the high cost of diesel fuel for trucking (Art. 7).
Finally, in Article 3 of the DL is the payment by instalments of bills, an option granted to companies for amounts due on electricity and natural gas for consumption within October 1, 2022 to March 31, 2023 and billed by September 30, 2023.
